In all but the simplest cases, litigation inevitably devolves into protracted battles over the right to sue itself. Lawsuits drag on for years without ever reaching the underlying dispute, as governments and corporations hide behind a minefield of legal principles designed to close the doors of justice and deprive the people of their day in court. When all else fails, laws which provide for special immunities and keep us in a perpetual “state of emergency” insulate the powerful from having to make amends for even the most egregious of wrongs.
