United States District Court, etc.
USA Speedway opened a commercial racetrack in Sterlington. The racetrack operated on Friday nights and sometimes Saturday nights with races beginning at 7 p.m. and sometimes lasting until 2 a.m, and keeping residents awake. The plaintiffs alleged the dirt track created a large amount of airborne dust that intruded upon their property and created a noise level they considered a nuisance. 59 residents filed suit in August 2010 seeking damages and a permanent injunction against the operation of the racetrack. Attorney Clay Garside, who represented the plaintiffs, said the residents were agreeable to the racetrack operating at more reasonable times, but the owners refused, opting for an “all or nothing” decision from the court. Finally, in 2013 a Union Parish district court ruled that USA Speedway is forbidden to operate its racetrack.
